Supposedly the Podshow contract has been exposed

March 29th, 2006 by Johnny

So as I listened to this and I could not believe how restrictive and “old” school this contract sounded to me. I thought I remembered Adam railing against the “old” school way of things early on. I have no way to know if this is legitimate but from some of the rumors I have heard it is a pretty restrictive contract with Podshow. I am by no means a legal scholar and would not advise any one to do anything with a contract other than consult a lawyer.

However that being said I want to own my IP and do not think I could give it up completely. I have not in the past been very interested in the money side of this but with it becoming a significant part of my life I have started looking at ways to make some $. I do have a signed contract to do podcasting that is MUCH more open and friendly. I can not go into any details NDA but can say it is nothing like this. I really wonder what the fall out from this is going to be. I think this type of thing is why I so love Creative Commons. I want to maintain IP but I want to enable others to mix and mash-up and be creative with content.

If you ignore everything else in this post do not ignore this— before you sign any long term restrictive contract consult legal advise as well as speak with your peer’s to see what other options might be available to you.

Adam Curry’s shady Podshow contract exposed on Keith and the Girl podcast
An anonymous listener mailed the Podshow contract to Keith and the Girl’s PO Box and they read it on the show. Take a listen to see how few rights you would have left if you signed. see also: www.keithandthegirl.com/forums/showthread.php?p=28947

On Second Life as an OS –amazing new “Desktop” or UI to the Metaverse

March 28th, 2006 by Johnny

This was my response to the question of whether or not Second Life was an OS that Scoble and Winer had posed on their blogs and so since I had been saying this, Eric will back me up, that I had to respond.

It’s hard to prove it’s not an OS.

So what do you do in Windows, OSX, any *ix platform? Well you collect files that are organized in directory structure — ISL(in Second Life) see Inventory. These files are data that provides information in visual and textual ways ok still don’t see a schism between SL and OS. All right on an OS you can write code and create programs; yes you can do this in SL. On an OS you can install and run these programs, ever animate an avatar, drive a car or do you have a big screen TV in your house ISL that play’s movies, can you say media player. Ok so I am still searching for how SL is not an OS. OK think …. Oh I have it, the task bar and start button or dashboard… no you have one of those in SL. Um I can chat, e-mail, and collaborate as well as cruse the web. Well I can chat, e-mail, collaborate and.. wait I can not browse the web yes that’s it does not have a browser so it CAN not be an OS. Oh but wait boys and girls have you seen Ubrowser.com a browser that can be applied as a texture to 3D models. Hum ok it’s not an OS until Linden releases the Ubrowser but once they do what can’t it do? Oh and buy the way I was in Second Life awhile back and did not grok it until Eric set me down and showed me just how powerful it truly was. So I signed back up and am now blogging my SL existence at thoughtplasma.com yea that’s me ISL Thought Plasma look me up and tell me how I am wrong.

Ok so feed back on how it is not an OS and I have only seen one compelling reply as to why it is not an OS.” Scoble and Winer as aggregated by Cory have both mentioned Second Life as a next generation operating system. The analogy is flawed because Second Life will never provide the core services of a kernel such as hardware interfaces, memory management and process scheduling. Second Life is the next desktop” - The Daily Graze - Chris 3-27-06
Good call and of course this comes from some of the most amazing folks I have met in Second Life, The Electric Sheep. I could not agree more with his assessment and think we were all using the wrong semantic phraseology in the term OS. OS has become so interchangeable with your interface, which in 2006 is the desktop that we all misspoke. Yes SL could very well be the next desktop IMHO. I have heard many people speak about previous 3D like VRML, BlackSun and the likes and know that this ‘dream’ of virtual existence has been tried before. Hell I was a Virtual Reality consultant back in the early to mid 90’s so I know the industry pretty well. That’s part of why it bugs me that it took Eric Rice to get me back in to really grok SL. I should have seen it but made the same mistakes I see a lot of conversation on this topic making –well we’ve done this before and it did not work then so I don’t think it will work now. Well this is different and we now have enough people with broadband to make it feasible.

I also get that SL has some issues with its proprietary structures. However with LSL and some tools cooked and too be cooked I think the ’screw you I am taking my toys and going home’ argument goes away. I think you will be able to take models and animations in and out of SL before to long. You can already import. One of the big issues why I believe you can’t already export is you have had no place to take them other than animation packages. No other MMOG, WoW, Everquest, the Sims has this capacity either and they discourage economy. So on that front Liden Labs is way out ahead.

However when it comes to this environment think Pong or Apple II not Call of Duty 2 or Pentium 4, we are still very early on in its development.

Well this topic has become so large I am dedicating a blog to Second Life and its possibilities over at thoughtplasma.com so much more on this and other topics surrounding this amazing new “Desktop” or UI to the Metaverse.

You can store files there. You can script things (there’s a whole API). In fact, it’s a platform. You can build a video game inside of second life. Or a music store. Or a dance studio. Or a city. Or a helicopter. Or a video screen that plays whatever content you want. Or fountain that spits blood.

Sleep deprivation is a GOOD thing!

March 26th, 2006 by Johnny

Oh this is getting printed and put on the refrigerator for my wife, who always gives me crap about not sleeping. How shall I put this, I am a freak, I usually stay up until 2-3 am and since our baby has been born get up at 6:30- 7 am or if it is my turn to sleep in 8-9 am. So on average I get 5-6 hours of sleep a night. Now if I burn the candle supper hot I will occasionally take a nap but that is usually when I have had 3 or less hours of sleep. Yes I do worship at the dark alter of Starbucks and often when I push myself hard will indulge in the brain chemical pleasing Chocolate orgy but this by no means keeps me from the task at hand. I am often compelled to work, write, design or study/research. This is just they way I am made and have spent ages trying to tell all the “doom” Sayers that I am wired different and this is not ‘killing’ me. Well thank you professor Daniel Kripke for your research. I can now stay up till the wee hours of the morning and not feel that I am destroying my body and mind. Now where is my triple shot gingerbread late and that bag of M&M’s? — Seriously though I usually only drink water after 9 or 10 pm.

How many Starbucks until we get there?

March 25th, 2006 by Johnny

Having pored over the terms of service for all major mapping platforms I knew this was coming. In fact I sat in a meeting not 3 months ago and spoke of this exact eventuality. We are in the process of geo-coding the planet and we are just starting to see what all can be done with all this information based upon geographical proximity so it would make absolute sense or Adsense if you will for Google who brought us all this shinny new ajaxian mapping solution to cover every grid square with ads based upon GIS info.

My new driving directions

1. Head south from Starbucks - go 0.5mi

2. Turn left at McDonalds - go 3.4mi

3. Turn right at Coca-Cola Billboard - go 2.1mi

4. Turn left into Shenanigans parking lot — (try our new Shenani Burger feast) go 0.1mi

Yahoo! Publisher Network

March 22nd, 2006 by Johnny

Yahoo is setting up a service that will allow web sites to insert ads related to content into our web sites and make some money… this sounds vaguely familiar ;) I will check it out. I wonder if Pirillo is going to write an e-book on this? We will see how much money can be generated through Yahoo’s system and what the differences or advantages they offer over Adsense.

Yahoo! Publisher Network
The new Yahoo! Publisher Network platform is now in beta and it enables you to:

  • Generate additional revenue from your site. Display ads related to the content on your site. You’ll earn revenue from qualified clicks.
  • Take advantage of Yahoo! Publisher tools, services and programs. Integrate other Yahoo! services into your web site, including Add to My Yahoo! (RSS), Y!Q and much more to come…
  • Help shape what Yahoo! offers the publishing community. This beta program is just the beginning. Our mission is to deliver products and services based on the needs of the publishing community.

The podcasting rule book | The Register

March 21st, 2006 by Johnny

Well here we go a license for podcasting to be able to play music in the UK. The caveats don’t seem that crazy “obscure at least 10 seconds at the beginning and end of each individual track played in a podcast with speech or a station ID;” and so on sounds very radio. You can check out more on the Limited Online Exploitation Licence (LOEL) at that link. Everything in this post talks about the UK so we will have to wait and see what ASCAP , HFA, BMI and all the others say on this side of the pond… ? We will be watching.

The podcasting rule book | The Register

The Mechanical-Copyright Protection Society and the Performing Right Society have launched a licensing scheme for music podcasters. The MCPS and PRS plan to assess the operation of the licence and update the scheme early next year.
